French Packaging Law

In 2014, the French Environmental Code R.543-172 to R.543-206 translated the EU WEEE Directive into national law, clarifying recycling requirements for electronic and electrical products sold in France.
In fact, France in 1975 clarified the Responsabilite elargie des producteurs (REP), requiring producers to be responsible for the recycling of waste produced by their products.
The French Environment and Energy Management Agency (ADEME) is the head of waste recycling, which has a SYDEREP (SYsteme DEclaratif des filieres REP) system to implement waste furniture, scrap electrical and electronic equipment (WEEE), household packaging, waste batteries and batteries (PA), waste paper, fluoridated gas (GF), old tires (PU) and scrap vehicles (ELV).

The Packing and Packaging Act requires manufacturers, distributors or importers of packaging or packaged products to contribute to the cost of waste disposal. The packaging law states that it is mandatory for all sellers to declare product packaging materials using material type (i.e. paper, cardboard, plastic) and weight.

Do I need to Register?

If you are selling products in France, you are required to register with an EPR Packaging provider and declare recycling. In France Packaging recycling is declared once a year.

NOTE: if you are an Amazon seller, as of 1st of January 2022 it is also an Amazon Seller Central requirement for all vendors selling goods that fall under French EPR to register with and EPR Service Provider.

Question: Who has to get a packaging license in France?

Answer: Anyone who sells cross-border sales to consumers in France needs to follow the same rules as local French companies and must be registered in the French recycling program.


Therefore, the French packaging law also applies to Germany, Austria, Great Britain, and even American and Chinese companies.

It is recommended to start with the first French order and start the registration. The only exception is for pure B2B retailers outside of France, as in this case the French importers have assumed the obligation to register.
