What is EPR (Extended Producer Responsibility)?

Extended Producer Responsibility or EPR for short, is a policy that makes the seller (i.e. the "Producer",  importer or manufacturer) responsible for the entire lifecycle of the products they sell on the market (and their packaging, batteries etc..) from the start until the end of the products life.

This includes waste collection and recycling.

Under EPR regulations, the seller must reduce the impact their products have on the environment throughout the products lifetime.

So who is considered as the responsible party?

Although I used the term seller, because in most cases it will be the person/entity that is selling the product in the country, it may not always be the case. In general it is the party that first introduces the product subject to EPR requirements into the country. so this could be:

  • the manufacturer of the product

  • the importer of the product

  • seller of the product

What do you need to do as an Amazon Seller?

Starting in 2022, if you sell in Amazon France and/or Amazon Germany, Amazon will be legally obliged to confirm that you are EPR compliant in the country where you sell.

Although your EPR responsibilities do not change just because you are selling through the amazon platform, you are however, obliged to comply with amazon seller policies.

Amazon will therefore collect and validate your EPR registration number(s). This means that as of January 1st 2022, you must register for EPR and provide amazon with your EPR registration number as proof. Failure to do so can result in restrictions imposed on your seller account.

So, what do you need to do?

If you are a producer of products subject to EPR requirements, you will need to register and provide amazon with your EPR registration number(s).

If you are a reseller of the products and do not import them into the country, then you will need to obtain the EPR registration number from the producer, and provide amazon with the producers EPR registration number(s) as proof of EPR compliance. If you cannot obtain the EPR number from the producer, you are required to register for EPR and provide amazon with your EPR registration number(s).

Here are 3 Simple Steps to EPR Compliance

Step 1

This is a one time process to obtain your EPR Registration Number, which you can then use as proof of compliance.

Step 2

You must declare your sales to the Producer Responsibility Organisation for the applicable reporting period.

Step 3

You must pay eco-contributions to the relevant Producer Responsibility Organisation(s).

Which EPR Categories do I need to register for?

This entirely depends on the type of products you are selling, the type of packaging used for your products as well as additional packaging used when shipping to consumers.

This could be things like electronics, light bulbs, batteries, furniture, etc.

Here is a table of the current EPR product categories in Germany and France.

* NOTE: For Germany, if you are selling an electronic product that contains batteries, you have to register for both Electronic and Electric Equipment (EEE) and Batteries EPR.
